Dan Thanked for His Compliance with the City's Laws

In August 2008 the city sends a letter to Deputy Mayor Dalager. It was a notice that he is no longer in violation of city codes now that he has converted his 3 unit rental building back to a 2 unit building.
These pictures are from today. It is curious, but not definitive, that there are now three addresses on the building.

  6. Dan Dalagher is an outstanding guy to have as a deputy mayor. He is at least born and raised Encinitas, more local than you will ever be. Think of the guy who just lost his apartment cause of city code. It's always easy (and juvenile) to be overly critical of people in public office.

  7. Dan's got plenty of room for a third unit on that property. It's too bad that the city goes apeshit about his tiny kingdom, yet is eager to approve new developments to cram neighborhoods anywhere else. There's nothing gracious about that thank you letter from the city to Dan. But if it wasn't for double-standards, we wouldn't have our great government.
    The other thing I don't understand is why Dan would still be for redevelopment. Guess double standards aren't limited to the workplace.

  8. We tried to get a second house number at our property during remodeling and were told that it wasn't possible unless the lot was split. It would be interesting to know about the multiple numbers deal.

    Does the city have enough room for everyone else to have a third unit? Do we have enough $100 million dollar soccer fields for third units?
    Does Lynn Brann have enough room for a second unit?Is Dan special and not need to follow the law? Did Dan vote to take legal action against Lynn or not?

    1. The recently taken pictures show 3 units.

    2. The letter says he's allowed to have 2.

    People? We have a politician blatantly breaking the law. Let's crucify his ass (seriously). If they don't follow the law their sworn to uphold then who the hell will?

  14. If you have a chair,(any old chair, even a folding chair), old TV and a refrigerator in your garage, working or not, the city considers this a illegal unit and you are subject to fine. Try to reason with them, if you dare.

    Bullshit.
    It is much easier sticking our heads in the sand. I've never believed that Dalager was anything other than very human and I put the responsibility for Dalager & Co's million dollar repeated mistakes on the voters and the council's enablers. Be assured there are many of Dalager's warts that have not made it to the blog.

    I did think of that guy in the third unit and I assumed that she/he signed a wise lease before moving in. That should have put Dalager on the hook for breaking the contract (and signing a contract to rent an illegal unit).

    These are three separate units, not a garage with a broken refrigerator. If you've been fined for a fridge, you have been exposed to the unequal enforcement of the law, Encinitas Style.

  16. The city looks the other way when illegalities are committed by themselves or by their minions. Cases in point: 1. Lynn Braun was sued by the City for an illegal garage conversion and now owes the City $90k for attorney fees, fees that Glenn Sabine will personally benefit from because the City hired his firm to pursue the matter. 2. The boathouses deal was signed and delivered based upon the City getting money to buy them, which money was put up by an Encinitan landowner with three illegal units on his property on Melba, which units were raided by DEA agents over a year ago, which units the City had concluded are illegal, which units still are being rented, and landowner has not paid one red cent in fines yet.
    Morale of the story: if you have illegal units, or want to build one, go kiss Dalager's ass.

    Since the author of this blog is expanding his business in longboard grotto's old space, he should probably tread lightly on politicians. It was nice of him to post the information in a non-accusatory way. Who knows? It might inspire some bitter politician hating poor slob with too much time on his hands and nothing to lose to make a formal complaint.

  23. I am a surporter for the redevelopment of the longboard grotto. I am in need of another surfboard and I have vowed to buy the new board at the grotto when it re-opens (grotto or whatever they call it).

    Like I said, I am glad that the author of this blog is not posting anything negative about a politician. Just posting a thank you letter and some picts is not accusatory. I imagine some newspaper reporter or bitter politician hating slob like myself will take it from here.

  26. What the citizens of Encinitas don't understand is there is a double standard regarding (illegal) units and additions people have built on their properties. Code enforcement will, depending on how they feel at the time, how first appearances go and if someone they take a fancy to is the person informing on a code violator.
    If the District Attorney (Bonnie) were to ever see how code enforcement wields an iron hand when they see fit and looks the other way for friends there could be criminal charges. (ha-ha)
    Every violation, every charge should be exposed with the outcome public knowledge. These are laws for every citizen to obey, when they aren't we have the right to know why.
    The Freedom of Information Act allows citizens to demand that code enforcement open their records to expose the informers. Remember that when you narc on your neighbor. Paybacks are a bitch.
